California Applicant Privacy Notice

The purpose of this Privacy Notice (“Notice”) is to inform California residents who are applicants for employment at Haas Automation, Inc., of 2800 Sturgis Rd., Oxnard, CA 93030, USA (the “Company”), and its affiliates (together, the “Group”, “we”, “us”, or “our”), of the categories of personal information we collect, the purposes for which we use the personal information, where we get the information, whom we share it with, and your rights over that information.  

We define “personal information” broadly to mean information that can identify you or reasonably be linked to you. In addition, processing means any activity relating to personal information, including collection, storage, use, disclosure, and sharing. We receive personal information through the online application process, through interviews and communications with you, through professional recruitment firms and agencies, or through postings on job sites. If you use our website as part of your application process, please also refer to our Website Privacy Policy.

1.   Categories and Sources of Personal Information and Reasons for its Use

Collection and Use of Personal Information. We have collected the categories of personal information set out in this Section 1 from Applicants within the last 12 months. Note that the categories listed below are defined by California state law (the California Consumer Privacy Act (“CCPA”)). Inclusion of a category in the list below indicates only that we may collect some information within that category. It does not necessarily mean that we collect all information listed in a particular category for all of our Applicants.

Sources of Personal Information. We collect this personal information (or a subset of this personal information) directly from you, from recruiting agencies, from employment references you provide, or from our service providers.  We may also collect it from publicly available job or professional networking sites where you have posted such personal information (e.g. LinkedIn), or from employment screening and background check providers, government or regulatory bodies.

We have shared the data below with the third parties described in Section 2.

IDENTIFIERS: such as a real name, alias, postal address, unique personal identifier, online identifier internet protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers

 

This data is collected to:

  • Open and maintain your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process
  • Create records in our Human Resources and recruitment systems to manage our recruitment process.
  • Ensuring our compliance with laws and regulations, including verifying your right to work.
  • Process and manage applications for roles with us, evaluate you for open positions that match your interests and experience across Haas and manage your candidate profile.
  • Organize an interview, and to make you aware of employee benefits you may elect to receive or to determine any accommodations you may require (if you are required to travel to us to interview, we may use a subset of this information to arrange your travel).

PERSONAL INFORMATION categories listed in the California Civil Code Section 1798.80(e): Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, your name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information

This data is collected to:

  • Open and maintain your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.

CHARACTERISTICS OF PROTECTED CLASSIFICATIONS UNDER CALIFORNIA OR FEDERAL LAW: Includes race, ancestry, national origin, religion, age, mental and physical disability, sex, sexual orientation, gender identity and other protected classes.

A subset of this data is collected to:

  • Comply with our legal obligations
  • Further our commitment to diversity and inclusion programs and practices
  • Organize an interview, and to make you aware of employee benefits you may elect to receive or to determine any accommodations you may require (if you are required to travel to us to interview, we may use a subset of this information to arrange your travel).

PROFESSIONAL OR EMPLOYMENT–RELATED INFORMATION
  • Manage your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.
  • Create records in our Human Resources and recruitment systems to manage our recruitment process.

 

We do not, and will not, sell personal information or share personal information for cross context behavioral advertising, as those terms are defined in the CCPA. We also have not done so for the last 12 months. We also do not share personal information with third parties for their direct marketing purposes.

In addition to the categories of personal information above, we collect the following categories of sensitive personal information, none of which we share with third parties or to personalize marketing:

We do not process sensitive personal information beyond what is reasonably necessary to meet the purposes described above. We may rely on service providers to assist us with these efforts.

2. With whom do we Share Personal Information

We may disclose personal information for the purposes listed in this Notice to the following recipients:

  • To our affiliates so they can help us manage your application.
  • To our third party service providers to facilitate the services they provide to us (e.g., IT service providers, background screening providers and employment benefit providers) so we can process your application.
  • To fraud prevention agencies, law enforcement agencies, public and government authorities to meet our legal obligations.
  • As required or permitted by law, including to comply with a subpoena or similar legal process or government request, to entities or persons when Next reasonably believes that disclosure is legally required.
  • In connection with a sale, merger or acquisition.

3. Your rights

You are entitled to the rights described below regarding your personal information, subject to certain conditions and limitations. We may choose to offer these rights, even if we are not required to under applicable privacy law.

  • Right to Know – You may be entitled to request that we disclose to you personal information we have collected about you, the categories of sources from which we collected the information, the purposes of collecting the information, the categories of third parties with whom we have shared the information, the categories of personal information that we have shared with third parties for a business purpose, the categories of information sold, and the categories of third parties information is sold to. In some instances, you may have the right to receive the information about you in a portable and readily usable format.
  • Right to Opt-Out – You may have the right to opt-out of any information sharing that constitutes “selling” or “sharing” personal information under California law. As stated above, we do not sell personal information or share personal information for cross context behavioral advertising, as those terms are defined in the CCPA.
  • Right to Limit –You may have the right to direct us to limit our use of your sensitive personal information to certain purposes.  
  • Right to Deletion – Subject to certain conditions, you may be entitled to request that we delete personal information about you. We will not delete personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information by law.
  • Right to Correction – You may be entitled to request that we correct inaccurate personal information. We will not correct personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information as-is by law.

Data solely retained for data backup purposes is principally excluded from these rights until it is restored to an active system or next accessed or used for a sale, disclosure, or commercial purpose.

If you chose to exercise any of these rights, to the extent that they apply, privacy law prohibits us from discriminating against you on the basis of choosing to exercise your privacy rights.

4. Exercising Your Rights

You can exercise your privacy rights by submitting requests to us to exercise those rights and by taking other steps that will limit how your personal information is collected, used, and shared.

To the extent applicable to you, you may exercise your privacy rights by submitting a personal information request by visiting our Data Request Form, by calling us toll free at +1-833-979-0006 or by emailing us [email protected].

We may need to verify your identity before fulfilling your personal information request. To verify your identity, we may collect information from you, including, to the extent applicable, your name, contact information, your account information, or other personal identifying information. We will match this information against the personal information we have previously collected about you or against information available from consumer reports to verify your identity and to respond to your request. Personal information collected for purposes of verifying your request will only be used for verification and to respond to your Personal information request. If you maintain an account with us, we may require you to log in to that account as part of submitting your request.

If we are unable to verify your identity as part of your request, we will not be able to satisfy your request. We are not obligated to collect additional information in order to enable you to verify your identity. For deletion requests, you will be required to submit a verifiable request for deletion and then confirm separately that you want Personal information about you deleted.

If you would like to appoint an authorized agent to make a request on your behalf, we require you to verify your identity with us directly before we provide any requested information to your approved agent. Alternatively, your authorized agent may provide evidence of having power of attorney or acting as a conservator for you. Note that we may require you to verify your identity with us directly before we provide any requested information to your authorized agent unless your authorized agent has power of attorney or acts as a conservator, in which case we will not contact you directly. We may also request that any authorized agents verify their identity and may reach out to you directly to confirm that you have provided the agent with your permission to submit the request on your behalf. There may be circumstances where we will not be able to honor your request. For example, if you request deletion, we may need to retain certain Personal information to comply with our legal obligations or other permitted purposes. We will notify you if we are unable to honor your request.

We are only obligated to respond to Personal Information requests from the same consumer up to two times in a 12-month period. In addition, under applicable privacy law, and for the protection of your Personal Information, we may be limited in what Personal Information we can disclose.

We will maintain all of your privacy requests for at least 2 years. This information will not be used for any other purpose except to review compliance processes; it will not be shared except as necessary to comply with a legal obligation. Please note that under applicable privacy law, we are only obligated to respond to personal information requests from the same consumer up to two times in a 12-month period. In addition, under applicable privacy law, and for the protection of personal information, we may be limited in what personal information we can disclose.

5. Changes to this Notice

We may change this Notice at any time. The Notice, and any updates to the Notice, will be posted on https://www.haascnc.com/about/careers/applicant-privacy-notice.html. You may visit HaasCNC.com/Careers to view the most current version of the Notice. The date the Notice was last revised will appear at the top of the page as the effective date.
